GENERAL TERMS AND CONDITIONS
FOR THE ONLINE CHECK-IN
APPLICATION
1. INTRODUCTORY PROVISIONS
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) apply to online
reservations of accommodation services provided by the operator of the guesthouse, the use of
the operator’s online reservation system, the payment and cancellation terms of online
reservations made by the client(s) via this website, as well as all other rights and obligations
arising from the legal relationship established through an online reservation made using the
ONLINE CHECK-IN application.
1.2 Definitions:
1.2.1 The operator of the guesthouse and the online reservation system is:

These contact details are also used for lodging complaints and any other communication with
the operator.
1.2.2 Penzión PATRIOT** & Dependance PATRIOT* refer to the accommodation facilities
operated at Jeruzalemská 12 and Jeruzalemská 3, 917 01 Trnava (hereinafter referred to as
"the guesthouse").
1.2.3 The Client refers to any natural or legal person who enters into an accommodation
agreement with the Operator.
1.2.4 A Service refers to any activity performed by the Operator in accordance with its
business scope, especially accommodation and conference services.
1.2.5 A Group usually consists of 6 or more people booking accommodation for the same
arrival and departure dates.
1.2.6 An Event refers to a social gathering involving multiple services provided by the
guesthouse. Unless agreed otherwise, the person placing the order is the organizer.
1.2.7 Time of payment is when the recipient gains access to the paid amount, i.e., when it is
credited to the account or paid by card/cash.
1.2.8 Damage refers to actual damage and lost profit, compensated in money or, if agreed and
feasible, by restoring the previous condition.
1.3 The client is entitled to use the online reservation system only upon agreeing to the GTC.
Clients are encouraged to review the current GTC before making a reservation. The Operator
reserves the right to unilaterally amend these GTC, which become effective upon being
published on the website. If the client disagrees, they should not use the reservation system.
Confirming a reservation constitutes unconditional agreement with the GTC.
1.4 The client acknowledges that all prices and conditions apply exclusively to online
reservations made via the ONLINE CHECK-IN application.
1.5 By using the online system, the client declares they are at least 18 years old and legally
competent to enter into contracts.
1.6 A client acting as a consumer has the right to seek alternative dispute resolution (ADR). If
a complaint is rejected or unanswered within 30 days, the client can initiate ADR in
accordance with Act No. 391/2015 Coll. The responsible body is the Slovak Trade Inspection
or another authorized legal entity listed by the Ministry of Economy.
1.7 The client can also file a complaint via the EU online dispute resolution platform:

1.8 The Slovak Trade Inspection – Inspectorate for the Trnava Region (Pekárska 23, 917 01
Trnava) supervises the seller.
2. RESERVATION
2.1 When making an online reservation, the client has the option to search for currently
available accommodation capacities in the guesthouse based on the requirements entered in
the reservation form (arrival date, departure date, room type, etc.).
2.2 After selecting all the necessary details such as the start and end dates of the stay, room
type, additional services, and similar, the client fills in all the required information.
2.3 After completing all the required fields, completing the payment in accordance with these
Terms and Conditions, and verifying the information, a confirmation of the reservation
including the reservation number will be immediately sent to the client's provided email
address. The assigned reservation number is used to confirm the booking, as a reference for
any changes or cancellations, and as confirmation upon arrival. Therefore, the client is
obligated to keep the reservation number safe.
2.4 The accommodation contract or other service contract is concluded only upon
confirmation of the reservation including the reservation number. An automatically generated
notice of receipt of the reservation request into the reservation system of the guesthouse
operator is not considered binding acceptance of the reservation.
3. PAYMENT TERMS
3.1 The client is obligated to pay the full amount for the stay reserved through the online
reservation system at the time of booking via credit card payment service (eCard). For this
reason, during the online reservation process and eCard payment, the client is required to
provide a credit/debit card number. By confirming the reservation, the client agrees to the full
payment for the reserved stay in favor of the operator of the guesthouse (by charging the cost
of the stay) and authorizes the operator to carry out this payment. The total price of the stay is
immediately credited to the bank account of the guesthouse operator.
3.2 The procedures and actions of the guesthouse operator are based on ethical principles and
respect the privacy of the client. The reservation system currently uses the most modern
encryption systems for sensitive data, ensuring full security of the information provided by
the client during payment.
3.3 The client authorizes the guesthouse operator to verify the credit/debit card information
with the relevant bank call center or the company that issued the credit/debit card.
3.4 In cases where a particular service in the reservation system of the guesthouse operator
does not display a price or displays a price of zero, it means that the service is either not
available for the selected date or the price is not currently known. In such cases, submitting a
reservation through the operator's reservation system is considered an expression of interest in
the service, and the availability and price will be communicated to the client later. After being
informed of the availability and price, the client has the right to confirm or decline the
reservation.
4. CANCELLATION TERMS
4.1 Since the subject of the online reservations made by the client(s) through this website is
the provision of accommodation services for purposes other than residential use, the provision
of catering services, or the provision of services related to leisure activities to be provided at
an agreed time or within an agreed period, the client may not withdraw from the contract once
the guesthouse operator has confirmed the booking of accommodation, catering, and other
specified services for a specific date. Cancellation of service reservations in such cases is only
possible under the conditions determined by the guesthouse operator in the following points
of these General Terms and Conditions (GTC).
4.2 Any changes to an online reservation made by the client can be made electronically by
entering the client’s email address (used during the reservation) and the reservation number
assigned and sent to the client during the reservation process, or in writing, by phone, or by
email via the guesthouse operator’s reservation department at phone number: +421 33 551
2511, email: info@penzionpatriot.sk. When requesting a change to an online reservation, the
client is always required to provide the reservation number assigned during the reservation
process and sent to the email address provided by the client. If the client requests a change to
an existing online reservation that cannot be fulfilled due to capacity or other operational
reasons, the guesthouse operator will take all steps to meet the client's request. However, the
guesthouse operator is not obliged to comply with the client's request to modify the online
reservation, and the client is not entitled to any compensation or other fulfillment from the
guesthouse operator due to the impossibility of modifying the reservation.
4.3 In the event the client withdraws from the contract and cancels the reservation, the
guesthouse operator is entitled to a cancellation fee as follows:
Cancellation fees for all stays: 100% of the price of ordered and confirmed services if
canceled 5 days or less before the arrival date or on the day of arrival.
4.4 If the client fails to arrive for the reserved stay, the guesthouse operator is entitled to a
cancellation fee of 100% of the price of the ordered and confirmed services.
4.5 In case of the client's withdrawal from the contract and cancellation of the reservation, or
partial withdrawal and partial cancellation, or failure to arrive for promotional stays (Article 6
of the GTC), the guesthouse operator is entitled to a cancellation fee of 100% of the price of
the ordered and confirmed services.
4.6 In the event of withdrawal from the contract and cancellation of the reservation, partial
withdrawal and partial cancellation, or no-show, the guesthouse operator shall send the client
written or email notification of its claim for a cancellation fee and its amount under these
GTC within 14 days of:
– the client's withdrawal from the contract and cancellation of the reservation,
– partial withdrawal and partial cancellation, or
– the scheduled start date of the stay in case of no-show.
By confirming the booking and agreeing to these GTC, the client acknowledges and agrees
that in the event of withdrawal, cancellation, partial cancellation, or no-show, the guesthouse
operator is entitled to unilaterally offset the client’s claim for a refund of the stay payment
(paid at the time of online booking) against the guesthouse operator’s claim for the
cancellation fee as per these GTC, to the extent that the claims offset each other. The
guesthouse operator shall refund any excess amount due to the client via bank transfer to the
account used by the client to pay for the online booking, within 30 business days from the
day following the withdrawal, cancellation, partial cancellation, or no-show.
Bank charges associated with the refund are borne by the client.
5. SPECIAL PROVISIONS
5.1 In case of any ambiguities or questions arising during the online reservation process, the
client is entitled to contact the guesthouse operator's reservation department by phone at +421
33 551 2511 or via email at info@penzionpatriot.
5.2 Check-in on the day of arrival (as per the reservation) is possible from 3:00 PM.
Check-out on the day of departure (as per the reservation) is until 10:00 AM.
5.3 In the case of special requests (baby crib, late check-in or late check-out, or interest in
booking additional services), the client is entitled to contact the guesthouse operator’s
reservation department by phone at +421 33 551 2511 or via email at info@penzionpatriot.sk.
5.4 Smoking is allowed only in designated areas and rooms. Smoking is prohibited in all other
hotel premises, including all other interior facilities and rooms. In case of violation of this
prohibition, the hotel has the right to impose a fine of €200 for each confirmed violation.
5.5 The guest is obligated to comply with the provisions of the GTC and the Accommodation
Rules. If the guest seriously violates their obligations or acts against good morals, the hotel
has the right to terminate the service agreement before the agreed time expires. By signing or
beginning to use the hotel services, the guest confirms that they have been acquainted with the
accommodation rules, hotel price list, and the accommodation conditions.
5.6 Pre-authorization means the temporary hold of the client's financial funds on their
payment card as a deposit for minibar consumption, room pollution, or other serious breaches
of hotel operational rules.
5.7 In the case of pre-authorization, the hotel is entitled to hold the client's funds for a
maximum period of 10 (ten) days from the date the hold request was made on the client’s
payment card.
5.8 The hotel is obligated to inform the client about any additional use of the security deposit
to cover its claims against the client and the reasons for such post-departure charges.
6. PROMOTIONAL STAYS
6.1 The guesthouse operator is entitled to offer promotional stays (e.g., last minute, first
minute, etc.). The number of rooms allocated for promotional stays is limited.
6.2 Special terms and conditions apply to the booking and realization of promotional stays,
which take precedence over these General Terms and Conditions (GTC). These GTC shall
only apply to promotional stays in those parts that are not otherwise or specifically governed
by the special terms and conditions for promotional stays.
7. PERSONAL DATA PROTECTION
7.1 The guesthouse operator processes the client’s voluntarily provided personal data as
entered in the reservation form: name, surname, address, country of residence, email, and
telephone number. The processing of this data is necessary for booking the accommodation
services provided by the guesthouse operator and/or for handling the client's request for
information prior to providing accommodation services, and for fulfilling the operator’s legal
obligations. The processing is carried out for the time necessary to achieve the
aforementioned purposes.
7.2 The client may consent to receiving information about the guesthouse operator's news and
special offers (newsletter) by ticking the appropriate checkbox before submitting the
reservation. By doing so, the client, as the data subject, freely and voluntarily gives the
operator explicit consent under the Personal Data Protection Act and applicable EU
regulations to process the provided email address for marketing purposes – namely for
sending newsletters via email. This consent is granted for a period of 5 years.
7.3 The client is responsible for the completeness, accuracy, and correctness of the personal
data provided. In case of any changes to the provided personal data, the client is obliged to
notify the guesthouse operator without delay.
7.4 The client may withdraw consent to the processing of personal data for marketing
purposes (newsletter subscription) at any time by clicking the appropriate link included in
each marketing email, by sending an email to the guesthouse operator, or in person at the
guesthouse reception.
7.5 If the provided personal data becomes outdated, the client withdraws consent, the purpose
or retention period has expired, or legal reasons prohibit further storage, the stored personal
data will be deleted.
7.6 Personal data protection is governed by the provisions of the Slovak Personal Data
Protection Act and applicable EU regulations, which also govern the rights of the client as the
data subject. The client has the right to free access to information about the processing of their
stored data. Provided the legal requirements are met, the client also has the following rights:
(i) Right to access personal data,
(ii) Right to correct inaccurate data,
(iii) Right to restrict (block) processing,
(iv) Right to object to processing for direct marketing purposes,
(v) Right to deletion, particularly if the data is no longer needed for the purpose for which it
was collected or processed, or if consent has been withdrawn and there is no other legal basis
for processing, or if the data was processed unlawfully.
The client also has the right to data portability, meaning the right to receive their personal
data in a structured, commonly used, machine-readable format and to transfer such data to
another controller, where technically feasible.
7.7 If the client asserts any of their data protection rights with the guesthouse operator and
their identity cannot be verified from the request, or the operator has legitimate doubts about
the identity of the requester, the guesthouse operator reserves the right to request additional
information necessary to confirm the requester's identity.
7.8 As a data subject, the client has the right to lodge a complaint with the Office for
Personal Data Protection of the Slovak Republic, located at Hraničná 12, 820 07
Bratislava, if they suspect that their personal data is being processed unlawfully.
7.9 The guesthouse operator declares that personal data is processed solely for the purposes
mentioned above and in accordance with the Personal Data Protection Act and relevant EU
regulations, using appropriate technical, organizational, and security measures.
7.10 The client’s personal data may be shared to the necessary extent with the guesthouse
operator’s contracted service providers (third parties – recipients) if required to fulfill the
purpose for which the data was collected. These providers may include marketing service
providers, banks, etc. The data may only be used by these service providers for the purpose
for which the data was collected.
8. FINAL PROVISIONS
8.1 These General Terms and Conditions and the legal relationships arising from them are
governed by the legal system of the Slovak Republic.
8.2 If any provision of these GTC becomes invalid, ineffective, or unenforceable, such
invalidity, ineffectiveness, or unenforceability shall not affect the validity or enforceability of
the remaining provisions.
8.3 For matters not regulated by these GTC, the relevant provisions of the Civil Code, Act
No. 22/2004 Coll. on Electronic Commerce, Act No. 250/2007 Coll. on Consumer
Protection, and Act No. 102/2014 Coll. on Consumer Protection in Distance Contracts or
Off-Premises Contracts, as amended, shall apply.
8.4 By confirming the online reservation, the client agrees to these GTC and undertakes to
comply with them. The guesthouse operator reserves the right to amend these GTC. The
obligation to notify changes in writing is fulfilled by publishing the amended GTC on the
guesthouse operator’s website: www.penzionpatriot.sk
8.5 These GTC come into effect on September 1, 2022.
